Election Procedures

The National Labor Relations Board (“NLRB”) will conduct the vote in person at SBHH by secret ballot. Below are the details of the election:

Election Timeline

  • Date & Time: The secret ballot election will take place on November 13th, 2024, from 6am-8am, 1pm-3pm & 6pm-8pm. The election will be conducted in the All Purpose Room 1075.

  • Who Can Vote: All full-time, regular part-time and per diem professional and nonprofessional employees employed by the Employer at its facility located at 1400 Expo Pkwy, Sacramento, California in the following job classifications:

    • Voting Group - Unit A (Professional Unit): Included: Registered Nurse, Therapist, Adjunct Therapist, Case Manager, Social Worker, Clinical Educator.

      • Excluded: All other employees, confidential employees, employees represented by other labor organizations, guards, and supervisors as defined by the National Labor Relations Act.

    • Voting Group - Unit B (Non-Professional Unit): Included: Mental Health Technician/Mental Health Workers, Housekeeper, Cook, Food Service Worker, Licensed Vocational Nurse, Licensed Practical Nurse, Unit Secretary.

      • Excluded: All other employees, confidential employees, employees represented by other labor organizations, guards, and supervisors as defined by the National Labor Relations Act.

    • Others permitted to vote: The parties have agreed that the Facilities Maintenance Technician from Unit B (Non-Professional Unit) may vote in the election but their ballots will be challenged since their eligibility has not been resolved. No decision has been made regarding whether the individuals in this classifications or group is included in, or excluded from, the bargaining unit. The eligibility or inclusion of this individuals will be resolved, if necessary,following the election

Instructions to fill out and complete the ballot: 

  • For employees in Group A, the ballot will have two questions:

    • Do you wish to be included with non-professional employees in a unit for the purpose of collective bargaining? The choices will be “YES” or “NO”.

    • Do you wish to be represented for purposes of collective bargaining by National Union Healthcare Workers? The choices will be “YES” or “NO”.

  • For employees in Group B, the ballot will have one question:

    • Do you wish to be represented for purposes of collective bargaining by National Union Healthcare Workers? The choices will be “YES” or “NO”.

  • All you should do is place an “X” in the box of your choice, fold up the ballot and put it in the ballot box.  

Do not write anything else on the ballot such as your name, classification or department. If you do write anything else on the ballot other than the “X” in the box of your choice, the NLRB will likely not count your ballot.

  • Voting is quick, easy and secret. Please exercise your right to vote. A simple majority of those who actually appear, and vote determines the election result, either in favor of or against NUHW. Not voting does not mean a NO or a YES vote to the union; it means that your voice is not heard.

  • Counting the Vote: The NLRB agent will open all ballots and count them immediately following closure of the voting period at 8pm on November 13th, 2024. The result will be determined by the simple majority of votes actually cast in the election.

If you want to be represented by NUHW, simply place an “X” in the box labeled YES.
